Terms & Condition

1. Acceptance of Terms

By accessing or using Career Aid, you agree to comply with and be bound by these Terms and Conditions (the "Agreement"). If you do not agree to these terms, you must not use the Software.

Subject to your compliance with the terms of this Agreement, Career Aid grants you a limited, non-exclusive, non-transferable license to use the Software for personal or commercial purposes, as specified in the user documentation.

If the Software requires a subscription or payment, you agree to pay the applicable fees according to the plan selected. Payments will be made in advance, and no refunds will be issued unless otherwise stated.  Fees will be automatically renewed on an annual basis.  A notice of the intention not to renew must be communicated to Career Aid in writing no less than 30 days of the renewal date.

6. Updates and Modifications

Career Aid may, from time to time, provide updates, upgrades, or modifications to the Software. These updates may include bug fixes, new features, or other changes. You agree to receive these updates and incorporate them into your use of the Software.

7. Termination

Career Aid may suspend or terminate your access to the Software if you violate any terms of this Agreement. You may terminate your use of the Software at any time by discontinuing use.

Upon termination, all rights granted to you under this Agreement will immediately cease, and you must stop using the Software and delete any copies in your possession.

8. Intellectual Property

The Software and all associated intellectual property rights, including copyrights, trademarks, and patents, are owned by Career Aid or its licensors. No ownership rights are transferred to you under this Agreement.

9. Privacy

Your use of the Software may be subject to Career Aid’s Privacy Policy. By using the Software, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers

The Software is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  Career Aid does not guarantee that the Software will be error-free or uninterrupted.

11. Limitation of Liability

To the fullest extent permitted by law, Career Aid will not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the Software, even if Career Aid has been advised of the possibility of such damages. In no event shall Career Aid's liability exceed the amount you paid for the Software during the six (6) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Career Aid, its affiliates, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Software or any violation of this Agreement.

13. Governing Law

This Agreement will be governed by and construed in accordance with the laws of Ontario, Canada without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the courts located in Ontario, Canada.

14. Modifications to the Agreement

Career Aid reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Career Aid website or within the Software. Your continued use of the Software after such modifications will constitute your acceptance of the updated terms.
